1. Provider and Scope

These Terms apply to all purchases made via soviya.ai.
2. Payment Processing by Paddle (Merchant of Record)
Our order process is conducted by our online reseller Paddle.com Market Ltd. ("Paddle"). Paddle is the Merchant of Record for all our orders. Paddle handles payment processing, invoicing, and the calculation and remittance of applicable sales tax / VAT. Payment-related inquiries can be directed to Paddle (paddle.net) or to us (oleksii@soviya.ai).
3. Subject of the Contract: Pre-Sale of Lifetime Access
3.1. You are purchasing lifetime access to the AI coaching application Soviya (the "App") for a one-time price of €199, inclusive of any applicable VAT charged by Paddle as Merchant of Record. The offer is limited to 50 seats.
3.2. This is a pre-sale. The App is under development and will launch gradually, country by country. As a buyer you receive:
- guaranteed lifetime access from the moment the App becomes available in your country,
- early access before the regular launch, once technically available,
- project updates by email.
3.3. You are not purchasing an immediately usable application. No specific launch date is promised. If the App does not become available in your country within 30 months of purchase, the automatic refund under our Refund Policy applies (see /legal/refund).
3.4. "Lifetime" refers to the lifetime of the Soviya product, i.e. the period during which Soviya is operated.
4. Not a Medical or Therapeutic Service
Soviya is a coaching tool for self-reflection and personal development. Soviya is not psychotherapy, not a medical or healing service, and does not replace treatment by physicians, psychotherapists, or other healthcare professionals. Soviya does not provide diagnoses or treatment recommendations. If you experience health issues, particularly mental health concerns, please contact qualified professionals; in acute crises, contact your local emergency services.
5. Eligibility
5.1. The offer is directed at consumers who are at least 18 years old.
5.2. Access is personal and non-transferable.
5.3. Availability of the App depends on your country and follows the provider's staged rollout plan.
6. Liability
6.1. The provider is liable without limitation for intent and gross negligence, and for damages resulting from injury to life, body, or health.
6.2. In cases of simple negligence, the provider is liable only for breaches of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the contractual partner may regularly rely). In such cases, liability is limited to the foreseeable damage typical for this type of contract.
6.3. Liability under the German Product Liability Act remains unaffected.
7. Right of Withdrawal
Consumers have a statutory 14-day right of withdrawal. Details and the model withdrawal form are provided in the Withdrawal Notice at /legal/refund. In addition, we grant a voluntary refund guarantee that goes beyond the statutory right (also at /legal/refund).
8. Privacy
Information on the processing of personal data can be found in our Privacy Policy at /legal/privacy.
9. Final Provisions
9.1. The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of the country of their habitual residence.
9.2. The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
9.3. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
